Diritto di famiglia e cambiamento

The contribution, inserted in a forum entitled "Dalla famiglia fondata sul matrimonio alla famiglia fondata sulla procreazione?" (“From the family founded on marriage to the family founded on procreation?”) is based on a reading of Lenti's volume, Il diritto di famiglia. It examines the topic of change in the context of the study of family law in the various aspects of the constitutive fact of the family and of filiation. In particular, it examines the thesis of the deinstitutionalization of marriage and the presumed emptying of the content and bond of marriage both with regard to family obligations and with regard to divorce. In terms of filiation, it reveals the conflict between paradigms of filiation and the role that the principle of non-discrimination is sometimes made to assume as a vehicle for shifts in meaning.
